1. Acceptance of Terms
By accessing or using Skycot ("the Service"), operated by Skycot Pty Ltd ("we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.
We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms. We will notify you of material changes via email or in-app notification.
2. Account Registration
To use Skycot, you must create an account by signing in with your Google account via OAuth 2.0. By creating an account, you agree that:
- You are at least 18 years of age.
- You will maintain only one account per person.
- You are responsible for all activity that occurs under your account.
- You will keep your account credentials secure and not share access with others.
- The information you provide is accurate and complete.
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being misused.
3. Service Description
Skycot is a multi-agent AI platform that provides users with a personal team of AI specialists for productivity, scheduling, finance, fitness, and other domains. The Service includes:
- AI agent conversations with persistent memory.
- Integration with third-party services (Google Calendar, Gmail, Google Sheets, and others).
- Automated agent tasks and scheduled actions.
- Voice interaction capabilities (where available).
Important: Skycot is a productivity tool powered by artificial intelligence. It does not provide professional advice in any regulated field, including but not limited to legal, medical, financial, tax, or accounting advice. See Section 7 for details.
4. Acceptable Use
You agree to use Skycot only for lawful purposes and in accordance with these Terms. You must not:
- Use the Service for any illegal or unauthorised purpose.
- Attempt to gain unauthorised access to the Service, other accounts, or our systems.
- Use automated tools, bots, scrapers, or other software to access the Service outside of its intended interface.
- Transmit malware, viruses, or any other harmful code.
- Engage in any activity that disrupts or interferes with the Service or its infrastructure.
- Use the Service to generate content that is illegal, harmful, abusive, harassing, defamatory, or otherwise objectionable.
- Circumvent or attempt to circumvent usage limits, rate limits, or other technical restrictions.
- Resell, sublicence, or redistribute access to the Service without our written consent.
- Use the Service to develop a competing product or service.
5. Intellectual Property
Our property: The Skycot platform, including its design, code, branding, AI agent personalities, and underlying technology, is owned by Skycot Pty Ltd. You may not copy, modify, distribute, or reverse-engineer any part of the Service.
Your data: You retain ownership of all content you create, upload, or input into Skycot, including conversation messages, uploaded documents, and extracted memory facts. By using the Service, you grant us a limited licence to process, store, and transmit your content solely to provide and improve the Service.
AI-generated content: Responses generated by AI agents are produced by third-party AI models (primarily Anthropic's Claude). You may use AI-generated responses for your personal or business purposes, subject to any applicable third-party terms.
6. Third-Party Integrations
Skycot integrates with third-party services including Google Calendar, Gmail, Google Sheets, and others. When you connect these services:
- You authorise Skycot to access your data from those services as described in our Privacy Policy.
- Your use of third-party services is also governed by their respective terms of service.
- We are not responsible for the availability, accuracy, or content of third-party services.
- You can disconnect any integration at any time via Settings → Integrations.
7. AI-Generated Content Disclaimer
Skycot is NOT a substitute for professional advice.
AI agents on Skycot are powered by large language models and may produce responses that are inaccurate, incomplete, or misleading. You acknowledge and agree that:
- AI-generated responses are not professional advice of any kind (legal, medical, financial, tax, accounting, or otherwise).
- You should always verify important information independently before acting on it.
- Skycot and its AI agents are tools to assist your productivity — they are not substitutes for qualified professionals.
- We do not guarantee the accuracy, completeness, or suitability of any AI-generated content.
- You are solely responsible for decisions made based on AI-generated responses.
Specific disclaimers:
- Tax & Accounting: Information provided by tax agents is general in nature based on published ATO rates. It is not personal tax advice. For complex tax situations, lodgement, or audit matters, consult a registered tax agent.
- Financial Planning: Financial guidance is general information only, not personal financial advice. Consult an AFSL-licensed financial adviser before making investment decisions.
- Legal: Legal information is general guidance only. It does not constitute legal advice. Consult a qualified solicitor or lawyer for legal matters.
- Health & Fitness: Health information is general in nature. It is not medical advice. Consult a healthcare professional before starting any exercise program or making health decisions.
- Mental Wellness: Mental wellness features are informational tools, not therapy or crisis intervention. If you are in crisis, contact Lifeline (13 11 14), Beyond Blue (1300 22 4636), or emergency services (000).
8. Subscription & Billing
Skycot offers both free and paid subscription tiers. By subscribing to a paid plan, you agree that:
- All payments are processed securely by Stripe. Skycot does not store your credit card details.
- Subscriptions renew automatically at the end of each billing period (monthly or annual) unless cancelled before the renewal date.
- You can cancel your subscription at any time via Settings → Plans & Billing or through the Stripe customer portal. Cancellation takes effect at the end of the current billing period.
- Refunds are handled on a case-by-case basis. Contact billing@skycot.com for refund requests.
- We reserve the right to change pricing with 30 days' notice. Existing subscriptions will be honoured at their current rate until the next renewal.
- Add-on message and voice minute packs are one-time purchases and are non-refundable.
Usage limits (messages, voice minutes) reset according to your billing cycle. Unused allowances do not roll over unless otherwise stated.
9. Data & Privacy
Your privacy is important to us. Our collection, use, and protection of your data is governed by our Privacy Policy, which forms part of these Terms. Key points include:
- You retain ownership of your data at all times.
- You can view, export, and delete your data via the application.
- We do not sell your data to third parties.
- Google data usage complies with the Google API Services User Data Policy, including Limited Use requirements.
10. Service Availability & Modifications
We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We reserve the right to:
- Modify, suspend, or discontinue any part of the Service at any time, with reasonable notice where practicable.
- Perform scheduled maintenance that may temporarily affect availability.
- Update or change features, functionality, or pricing of the Service.
11. Limitation of Liability
To the maximum extent permitted by applicable law:
- The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.
- We do not warrant that the Service will be error-free, secure, or available at all times.
- We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
- Our total liability to you for any claim arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
- We are not liable for any loss or damage resulting from reliance on AI-generated content.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable Australian law, including liability under the Australian Consumer Law.
12. Indemnification
You agree to indemnify and hold harmless Skycot Pty Ltd, its directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:
- Your use of the Service.
- Your violation of these Terms.
- Your violation of any applicable law or regulation.
- Any content you submit or transmit through the Service.
13. Termination
You may delete your account at any time through Settings → Profile. Upon account deletion:
- All your data, including conversations, memories, and integration tokens, will be permanently deleted.
- Any active subscription will be cancelled.
- This action is irreversible.
We may suspend or terminate your account if you violate these Terms, with notice where reasonably practicable.
14. Modifications to Terms
We may revise these Terms at any time by posting the updated version on this page with a new "Last updated" date. Material changes will be communicated via email or in-app notification at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
